Who we are

Our Services

We offer an introducer service for Islamic finance and Financial Services. This means we will:

  • Explain all parts of the finance (Home Purchase Plan HPP / Buy to Let Purchase Plan (BTLPP) or financial service to you and the value we’ll add to your journey.
  • Get to know you, and understand your needs, preferences and circumstances.
  • Identify your lifestyle and financial expectations over the life of the HPP or service.
  • Explore your needs fully and raise any contradictions which we’ll discuss to clearly establish your needs and priorities.
  • Introduce you to specialist third party service providers.
  • Assist you with the process to secure your finance product or financial service.
  • We may offer you a referral to a provider Financial Planning and Services, Legal Services.

 

Your enquiry

We aim to be able to help all our customers, however we may be unable or refuse to proceed with an application if:

  • your chosen product is no longer available and where an alternative product cannot be sourced/provided;
  • there has been a pricing or product description error by the provider and where an alternative product cannot be sourced/provided;
  • your required documentation cannot be verified;
  • we believe that you are unlikely to be suitable for products or services that we can provide;
  • your application has been declined by providers;
  • we have reason to believe that information that you have provided to us is inaccurate or misleading;
  • we have reason to believe that you have made a high volume of applications/enquiries and/or have repeatedly applied and withdrawn your application in a frivolous manner;
  • you fail our Anti Money Laundering (AML) and Counter Terrorist Financing (CTF) due diligence processes;
  • the application appears to be for purposes that do not fit within the scope of our service (including as set out in these terms); We’ll contact you to let you know if we’re able to process your application.

By engaging with our team to provide you with our services, you agree that we may act on your behalf in liaising with the any third parties involved in the process. As an introducer, we never own the products or services you buy or transact through us.

Our authority to act on your behalf in accordance with these Terms of Business can be terminated at any time by either side in writing, without prior notice and without penalty. This will be effective from the date the notification is received. However, if transactions already initiated remain outstanding, the notification will only be effected once these have been completed.

We cannot guarantee that your application will be considered or accepted by a product or service provider and we’ll have no responsibility for ensuring that the product or service is entered into or fulfilled.

Other than helping you to get a product or service, we won’t be involved in your purchase process. You will be responsible for providing all necessary details of the product and provider to your solicitor or conveyancing practitioner.

You may withdraw your enquiry at any time before a product or service has been entered by contacting us using the details provided above. Please note any non-refundable lender / financier / service provider fees already paid or payable may not be refunded if you cancel an enquiry / application.

 

Duty of disclosure

Any suggestions provided are based on your personal financial circumstances and objectives. It is important that the information you provide is both accurate and honest, and a true reflection of your circumstances. It is your responsibility to provide information in this way to a provider or organisation that provides products and services recommended for you. Failure to disclose relevant information, or change of circumstances, to a provider may result in your chosen plan or product being invalidated.

We strongly recommend that any information provided is checked thoroughly prior to submission.

 

Fees and Costs

AV Associates may charge for its Home Purchase Plan (HPP)* and Buy to Let Purchase Plans (BTLPP)* introduction services. In addition, you should be aware of the possibility that other taxes or costs relating to the services that we provide for you may exist even though they are not paid through us, or imposed by us as there may be additional costs and charges relating to products and services that you require.

You’ll receive a Key Facts Illustration directly from the provider when considering a particular HPP, BTLPP or service, which will detail any fees relating to it.

We receive referral commission from the banks, financiers, service providers. If you would like to see a list of the commission rates payable by the providers we have access to, please ask your adviser. The precise amount paid varies from provider to provider.

 

Financial Crime

The FCA, requires us to have adequate systems and controls in place to prevent the furtherance of Financial Crime.

All transactions relating to our services provided are covered by, and adhere to, the Money Laundering regulations and Proceeds of Crime Act.

Our responsibilities include, but are not limited to, verifying the identity and address of our customers. We’ll also require proof of your income and expenditure, and source of any deposit funds to further satisfy these requirements.

Your adviser will confirm what documentation is required.

 

Data Protection and privacy

We’ll hold the personal information provided by you securely and in confidence. Please see our privacy policy for more details on how we collect, use and retain your data. By using our site, you consent to such processing and you warrant that all data provided by you is accurate

By submitting your personal information to us you agree that: information provided by you may be held, processed, disclosed and used by us, and any associated companies servicing our relationship with you; any information which you give us may be disclosed to selected third parties or group companies for the purpose of administration as permitted by law.

Please note that we’ll not arrange to involve a third party, unless the security and confidentiality of your personal information is assured.

If we have to contact you we’ll do so by telephone, SMS, or by writing to you at the email address or postal address you provided to us in your application and in accordance with our privacy policy

If any provision of these Terms of Business is found to be invalid or unenforceable in whole or in part, the validity of the other provisions of these Terms and the remainder of the provision in question will not be affected.

These Terms supersede all proposals, prior discussions and representations (whether oral or written) between us relating to our appointment as your agent in connection with the arranging and administration of your mortgage. These Terms constitute an offer by us to act on your behalf in the arranging of financial products and services. In the absence of any specific acceptance communicated to us by you (whether verbal or written) you are deemed
to accept our offer to act for you on the basis of these Terms, by conduct, upon your instructing us to arrange, renew or otherwise act for you in connection with the services.

We may assign or transfer this contract or our obligations under it to another entity. This will not affect your rights or our obligations to you under this contract

These Terms shall be governed by the laws of England and Wales and you agree that any dispute (including any non-contractual dispute) arising out of your agreement to use our services shall be subject to the exclusive jurisdiction of the English courts. The language in which this contract will be interpreted, and in which all communications will be conducted, will be English. The Contracts (Rights of Third Parties) Act 1999 will not apply to these Terms of Business.
